The Settlement Process
In order to settle a workers' compensation claim, your employer must agree to the settlement. The Ohio Bureau of Workers' Compensation (OHBWC) approves claim settlements. To ensure that a settlement is fair to all involved parties, the Industrial Commission of Ohio may review the settlement within 30 days.
You may settle your entire claim, which usually includes all past, present and future expenses (medical benefits and wages). The OHBWC calculates settlement amounts based on the expected future cost of your injury and then prorates that amount to reflect the probability of the costs occurring. An experienced workers' comp attorney can present your strongest case for an adequate settlement. Trying to negotiate with the OHBWC on your own will likely be difficult.
If your injury occurred before September 2006, there is a 10-year statute of limitations for settling your claim. If your injury occurred after that date, you have five years to settle your claim from the last date of compensation or the date of your injury, whichever is later.
