The process of obtaining Social Security Disability/Supplemental Security Income (SSDI) benefits is usually lengthy and complex. However, if you are age 50 or over, your chances of being approved are usually better. We still recommend working with an SSDI attorney to make the process easier.
Mondello & Levey has represented thousands of people with SSDI claims. Our attorneys have the knowledge and experience to help you present your strongest claim for benefits. We can help you through the Social Security process, no matter what age you are. To discuss your claim, please call 216-586-2010 or 866-246-7108, or contact us online for a free consultation.
Your Ability to Work
The Social Security Administration (SSA) awards SSDI benefits based on your ability to perform either your past work or a different job to which your past work skills may reasonably expect to transfer. To make this determination, the SSA considers your residual functional capacity, which they define as "the most you can still do despite your limitations."
If you lack the residual functional capacity to perform your past job or other substantial gainful activity, you may receive Social Security Disability Insurance or Supplemental Security Income benefits. For people over age 50, the SSA considers whether they can still do the work they did over the last 15 years. It is generally easier to get benefits if you are over age 50 because the medical-vocational rules are more favorable to people in this age bracket.
You must prove that you have a medically determinable physical or medical condition, or combination of conditions, that prevent you from working. You must see a doctor and get medical reports documenting each condition. We can help you gather the necessary medical information and present it to the SSA, whether you are going through reconsideration, the hearing or the appeals stage.
