Appeals Before the Industrial Commission
The Industrial Commission functions like a court that hears denied workers' compensation cases. You need representation if you have a hearing before the Industrial Commission. Your employer will be represented by an experienced actuarial or an attorney. They are there to protect the company from expense, not to look out for your best interests.
OHBWC decisions can be appealed. The appeals process starts with a hearing before a district hearing officer. If your claim is denied at this level, you can appeal the decision. The next stage is a hearing before a staff hearing officer. You may appeal this decision and be granted a hearing before the full Industrial Commission.
If the commission denies your claim, you can appeal that decision in a Court of Common Pleas in the district where your injury occurred. We can represent you at this stage as well.
